General Terms and Conditions of ‘Peter Betteridge Furnishers Limited’, also trading as ‘The Bed Expert’, ‘The Sofa Expert’ These terms and conditions are applicable to on-line orders placed via our websites.

General Information

By purchasing through this website you agree to be bound by the Terms and Conditions as laid out below. These terms and conditions apply to online transactions only. These conditions do not affect your statutory rights as a Consumer.
All goods sold are subject to these terms and conditions of sale. No addition, alteration, variation or waiver of any term of these conditions of sale shall be binding unless agreed in writing with the parties. The customer shall be deemed to have agreed to these conditions in relation to any transaction between the two parties.
No customer terms and conditions of purchase or no other warranties, standards, specifications and other matters whether written or oral, express or implied, shall form part or deemed to be incorporated into this contract unless agreed in writing by an authorised officer of each party.
All other terms and conditions express or implied by statute or otherwise are excluded to the fullest extent permitted by law.

The Peter Betteridge Furnishers Ltd reserves the right to change the terms and conditions from time to time.

Nothing in these terms and conditions shall affect the statutory rights of the consumer.
These conditions of sale shall be governed by and construed in accordance with English law and each party agree to submit to the exclusive jurisdiction of the English courts.

Your Order

The customer (Buyer) shall be responsible for ensuring the accuracy of all details provided when completing the order. Peter Betteridge Furnishers Ltd is not obliged to accept the order unless all details requested on the order form have been completed correctly.

Order Process:

i) Customer to complete in full the customer order form. 
ii) On receipt of your order we will send an acknowledgement email confirming the status of the 
order. 
iii) Your order will be delivered by a courier of our choice.

All items are subject to availability. We will inform you as soon as possible if the goods you have ordered are not available. We do not have a live stock system on our website therefore some items will not be in stock even though you can place orders for them - we will notify you as soon as we start processing your order if you would prefer not to wait then you are entitled to a refund and to cancel the order.


No customer orders shall be deemed to be accepted by Peter Betteridge Furnishers Ltd until we confirm acceptance of an order by e-mail or in writing.
Peter Betteridge Furnishers Ltd is entitled to refuse any customer orders and will not be required to provide an explanation.
VAT at the current rate is included in the price of goods where appropriate.
It is a customer’s responsibility to ensure a product is of the correct dimensions at the time of ordering as Peter Betteridge Furnishers Ltd will not be liable for any returns/exchanges or refunds in these instances after the order is placed. It is the responsibility of the customer to ensure that any product ordered can be safely delivered to and access the delivery address through normal means i.e doorways, stairways, lifts etc. If ordered items cannot be delivered safely by normal means the Peter Betteridge Furnishers Ltd will not be liable for any returns/exchanges or refunds . The customer may incur additional costs where methods outside of ‘normal entry’ are applied ie. removal of doors, windows and the hiring of additional equipment.
When ordering from outside the UK or specifying a delivery address outside the UK it is recommended that you contact us by telephone before confirming the order so that we can discuss your requirements and any procedures. Failure to do so may result in the order not being accepted.

Delivery

The goods will be delivered to the customer at the address detailed on the order form.
Delivery is limited to within the United Kingdom. When ordering from outside the UK or specifying a delivery address outside the UK it is recommended that you contact us by telephone before confirming the order. Failure to do so may result in the order not being accepted.
In stock goods are normally dispatched within 48 hours of receipt of order (excluding weekends and public holidays). Where a customer’s delivery address needs verification this may be longer. Out of stock items usually take an extra week or two weeks to be delivered. and sometimes if a manufacturer is out of stock of an item it can be more than 14 working days from date of order.
Lead times for large items i.e. sofas beds and mattresses vary between manufacturers and are mainly made to order. Lead times are quoted in good faith and can be discussed with a member of our staff. There are occasions where situations beyond our control extend this lead time after placing your order such as factory holiday shutdowns and public holidays in originating countries. We will not be held responsible for any inconvenience or loss caused as a result of these situations delaying your order.
We aim to have stock available on all items however there are cases when this is not possible and items may be despatched directly from a manufacturer this will enable us to deliver goods more quickly this can take up 7-10 working days but is usually quicker.

In the event that you miss your delivery, a card will be left with contact details for collection from the delivery service provider.
The risk in the goods shall pass to the customer on delivery which must be signed for if required.
Any dates quoted for delivery of the goods are approximate only and Peter Betteridge Furnishers Ltd shall not be liable for any delay in delivery of the goods however caused.
For white glove deliveries our courier will contact you when they receive your complete order into the warehouse to arrange a delivery slot or either AM or PM. We will endeavour to contact you by telephone up to an hour before the scheduled delivery time but this cannot be guaranteed.
No orders will be delivered if there is an outstanding balance on your account. Delivery will be arranged after complete payment is taken or any finance arrangement is confirmed.
Extra charges may apply for deliveries to the Scottish Highlands and Northern Ireland, and other addresses outside the UK mainland. Any delivery charges form part of the order and must be agreed and paid for prior to delivery.

Delivery Charges

The charges listed below are a guide and the final delivery charge will be stated at the time of ordering.

Category - Bedding and Linen and smaller items
These items will be delivered via a method of our choice i.e Post/Courier

  • Orders over £100 - Free delivery
  • Orders £40 - £100 - £4.95
  • Orders under £40 - £6.95

These charges only apply to UK mainland. Other charges may apply to Highland, Islands and Northern Ireland.

Category - Beds, Mattresses, Bedsteads, Adjustables, Headboards, Furniture
Larger items – will be delivered using a ‘white glove service’. This generally involves a 2 person team who will deliver the item to the delivery address and place, unpackage and construct it at its final resting place.

  • Orders over £950 - Free Delivery
  • Orders under £950 - £49

These charges only apply to UK mainland. Other charges may apply to Highland, Islands and Northern Ireland.

Storage of Goods

For specified orders we can hold goods for a period of 4 weeks from receipt to our warehouse or courier without charge during that period. After 4 weeks customers will be charged storage relevant to the goods ordered and the duration of time held. The balance of the order must be paid in full after 4 weeks with risk of loss of the deposit or balance of the order against the cost of storage Customers will be contacted by phone or email to be advised of the charges.

Payment

The price of the goods will be the price detailed on the order and will include VAT at the current rate. Any relevant delivery charges will be detailed separately.
Payments for customer orders can be made by either credit or debit cards. By placing a customer order, you, the customer consents to payment being charged to your credit card detailed on the order form provided. We accept major credit and debit cards including Visa & Mastercard. WE DO NOT ACCEPT AMERICAN EXPRESS. We do accept direct bank transfers and cheques but will only process an order once the full balance has been cleared into our account.
All credit/debit transactions must have the billing address of the account holder verified and for security we will only send confirmation letters to the billing address. 
It is the customer’s responsibility to reply to all correspondence from us. If the customer has not received a letter within 3 working days of placing an order they need to contact us by telephone to request replacement paperwork. This is to protect both parties from fraudulent activity.

Description of goods

Peter Betteridge Furnishers Ltd has taken all reasonable care to ensure that all details, descriptions and prices of products appearing on the website have been fairly represented and described. However, the illustrations are for representative purposes only and the products may differ slightly from the images shown.
Peter Betteridge Furnishers Ltd reserves the right to substitute products of a similar description and of at least the same quality if the requested goods are not available. In this unlikely event the customer will be entitled to a full refund within 14 days of receipt of the order, should the substitute product not be acceptable.

Refunds and cancellation

If the goods supplied are incorrect, faulty or damaged on delivery we will either repair or exchange the product. In this event please contact us at sales@bedexpert.co.uk. On receipt of your goods please check to make sure the product is not faulty before use. This does not affect your statutory rights. See Returns and Refunds for more info.
Due to the nature of some of our products in the interests of health and hygiene reference Distance Sellers Act 2000 we are unable to offer a refund on any duvet, pillow, pillow case, mattress, mattress cover, bed linen or other item which is likely to be used against naked skin unless the product is faulty or the product is sealed and in a re-saleable condition. This does not affect your statutory rights.
A special order or made to order item i.e. a bed, headboard or mattress may be subject to a manufacturing cost. If you change your mind or cancel an order we will retain 20% of the balance of the purchase to cover our expenditures. Other items may be subject to a restocking charge. A bespoke Item is also exempt under the Distance Selling Act.

Clearance items are sold on a non-returnable basis - we encourage you to fully insppect the items before purchasing in our stores.

Liability

If an error is discovered in the price of the goods that you have ordered, we will inform you as soon as possible. In the event that you order an item and the price published on this website is incorrect for any reason, we will contact you to let you know the correct price and ask you whether you still wish us to fulfil your order at this price. We shall be under no obligation to fulfil an order for a product which was advertised at an incorrect price.
We shall give you the option of confirming the order at the correct price or if you so choose, to cancel the order altogether. If you cancel and have already paid for the goods in the circumstances described in this clause, we shall refund the full amount in accordance with these Terms.

Limitation of liability

Peter Betteridge Furnishers Ltd shall not in any event be liable for any loss of profit or other indirect or consequential loss or damage howsoever arising.
Except as specifically provided in these terms and conditions, Peter Betteridge Furnishers Ltd shall be under no liability for any loss or damage whatsoever attributable to any act, default or failure to carry out the contract terms.
If the ability of Peter Betteridge Furnishers Ltd to perform its obligations is limited, delayed or prevented in whole or part by any reason whatsoever not reasonably within the control of Peter Betteridge Furnishers Ltd, then Peter Betteridge Furnishers Ltd shall be excused, discharged and released without penalty from performance of the contract to the extent that such performance is so limited, delayed or prevented.

Complaints

If you are not entirely satisfied with your purchase please contact our customer service department via email emma@bedexpert.co.uk or call 01548853503 We will try to resolve any issues that you have as quickly as possible and if necessary we will explain how to follow our complaints procedure.

If you remain unhappy with our final response, you may be entitled to refer your complaint to The Furniture Ombudsman and we are bound to follow any decision that they make.
